Minimum Order
The minimum order is €5.00, below which we are unable to cover the costs of preparation and invoicing.
Right of Withdrawal
Pursuant to art. 5 of Legislative Decree 22 May 1999 no. 185, the Customer (if qualified as a "consumer" pursuant to art.1 letter b) of Legislative Decree 22 May 1999 no. 185) has the right to withdraw from the contract within 10 (ten) working days from the date of receipt of the products, by sending written notice to the headquarters of Martilia Horse F&S Srls., by registered letter with return receipt. The communication is considered sent in due time if delivered to the accepting post office within the above deadline; it may also be sent by telegram, sent within the 10 days provided for, provided that it is confirmed by registered letter with return receipt within the following 48 hours.
The products must be returned complete with accessories inside the original packaging, carefully protected to avoid any damage, writing, or alteration. The deadline for returning the goods subject to withdrawal is set at 10 days from the date of exercise of the right and in any case no later than the 15th day from the date of receipt of the goods. The shipment, until actual delivery at the above address, remains entirely under the responsibility of the Customer; it is therefore recommended to ship the products by insured mail or insured courier. It is the Customer's responsibility to track the shipment with their carrier and check for any irregularities in delivery; Martilia Horse F&S Srls is in no way responsible for damage or theft/loss of goods returned with uninsured shipments.
Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. The right of withdrawal is totally forfeited, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Martilia Horse F&S Srls ascertains damage to the product for reasons other than its transport. Failure to comply with the prescribed procedures will allow Martilia Horse F&S Srls. to refuse the returned goods. In case of forfeiture of the right of withdrawal, Martilia Horse F&S Srls will return the purchased goods to the sender, charging the shipping costs to the sender. In case of valid exercise of the right of withdrawal, without prejudice to any restoration costs for damage found to the product, Martilia Horse F&S Srls will refund the purchase price as soon as possible, and in any case within 30 days from the date on which Martilia Horse F&S Srls. became aware of the exercise of the right of withdrawal. The costs of returning the goods are excluded from the right of withdrawal (pursuant to art 5, paragraph 6 of Legislative Decree 185/1999).
Jurisdiction
Without prejudice to the possible applicability of mandatory legal provisions for the protection of consumers (as defined pursuant to art.1 letter b) of Legislative Decree 22 May 1999 no. 185), any dispute in any way connected to these General Terms and Conditions of Sale will be subject to the exclusive jurisdiction of the Court of Civitavecchia.rse.com | +39 0651600108
